RULE: 2.26 - CONTROL AND EXCLUSIVE USE OF CONTAINERS Eff: 01NOV2018

a. Except as otherwise provided below, no shipment is
entitled to the exclusive use of the container in which
it is transported. Carrier retains the unrestricted
right of control over the transporting container and has
the unrestricted right to:
1. select the container(s) to be used for the
transportation of a shipment;
2. transfer the shipment to other container(s) or
transporting equipment during transportation service;
and
3. load other Cargo in the same container with any other
shipment (SBJ to the restrictions named in Rule 16).
b. Notwithstanding the above, a shipment will be assigned
the Exclusive Use of a Container, even though the
maximum inside carrying capacity of the container has
not been utilized, when:
1. such Exclusive Use of the Container is requested by the
Shipper, Consignee or their agent; or when
2. due to insufficient packaging or due to the nature of
the cargo, loading other cargo is precluded or
prohibited; or when
3. the container is loaded to 90% (ninety percent) or more
of the full visible capacity of the container; or when
4. the container is loaded to 100% (one-hundred percent)
of the container's maximum gross weight capacity or
U.S. Highway gross weight limitation, whichever is
lower; or when
5. Shipper loads, stows, counts and seals the container as
provided in Rule 2.23 herein.
c. The minimum charge for shipments accorded or assigned
Exclusive Use of Container Service will be the
applicable full container ("PC") rate when one is
published; or, when no full container rate is published,
the lawfully published rate stated on a measurement
basis computed at 90% (ninety percent) of the stated
total cubic capacity of the transporting container (See
EXCEPTIONS).
EXCEPTIONS:
1. When 2 (two) or more commodities, subject to different
rates are included in a single Exclusive Use Service
container, the minimum charge will be computed at the
measurement rate applicable for each separately rated
commodity in the container, and any deficit between
the actual total measurement within the container and
90% (ninety percent) of the transporting container's
stated cubic capacity, will be charged for at the rate
applicable to the lowest rated commodity in the
shipment.
