Should any Customs Service or other governmental authority order or
require Container to be subject to inspection or examination (whether or
not cargo must be discharged or unloaded from the container) for any
reason, all charges and expenses, including any applicable unloading,
reloading, storage, demurrage, detention or container per diem charges,
will be for the account of the cargo. Moreover, Carrier will NOT assume or
accept any risk or liability for the actions or omissions of such Customs
Services, governmental authorities or their agents.
PREPULL SERVICE:
When Customs Service orders that a container be presented at its facility,
on a specific day and at a specific time, and Carrier is not able to
present the container on the day and at the time required without
PrePulling the Container prior to the day Customs requires the Container be
presented and as a result the Container is held by the Carrier overnight,
Carrier will assess the PREPULL CHARGE (PPULL) named below, which charge
shall be in addition to all to all other applicable charges.
