Tristate does not provide COL containers for Shipper use. However, Cargo
tendered to, or delivered by, Tristate loaded in/on underlying VOCC
supplied containers or other equipment may be SBJ to Equipment
Detention/Demurrage Charges levied by such VOCC in accordance with such
VOCC's Tariff and Equipment Interchange Agreement. All Equipment
Detention/Demurrage Charges incurred while container or equipment is
not in Carrier's direct possession will be solely for the account of the
cargo and Carrier will NOT pay, reduce or absorb any portion of such
charges. As specified in Rule 21.1, when such Detention/Demurrage Charges
are billed directly to the Carrier by the VOCC after final delivery of
cargo at destination, Carrier will forward the invoice(s) to the person,
party or company who incurred the charges regardless of whether the
shipment status was prepaid or collect.
When Shipper, Consignee or party responsible for paying all freight and
charges, requests, requires or asks Tristate to be the party billed for any
Underlying Carrier or Leasing Company Per Diem Comtainer/Equipment charges,
Tristate will pay such Per Diem charges and then invoice those Per Diem
charges, at cost, back to the party responsible for the payment of all
freight and charges, SBJ to the additional Handling Charge below, which
charge shall be in addition to all other applicable charges.
