If the shipper or a member of a shipper's association
tendering the cargo is identified as an NVOCC, the carrier
shall obtain documentation that the NVOCC has a tariff and
a bond as required by Sections 8 and 23 of the Shipping Act
1984 before the Carrier accepts or transports cargo for the
account of the NVOCC. A copy of the tariff rule published
by the NVOCC and in effect under CFR 46, 514.15(b) (25)
will be accepted by the Carrier as documenting the NVOCC's
compliance with the tariff and bonding requirements of the
Act.
