(APPLICABLE ONLY WHEN SPECIFIC REFERENCE IS MADE TO TRANSIT SERVICE
DEFINITION FOR HOUSEHOLD GOODS)
When specific reference is made in a governed NSA, rates named
thereon/therein shall apply via a specific transportation service which
will be shown in connection with each rate. A full description of
each transportation service offered is listed below:
a. When different rates applying on Household Goods, from the same
ports/points to the same ports/points are published in a governed NSA
and the application of each rate is based on different Transit Service
level, selection of Transit Service and the related rate level will
be strictly at the Shipper's option. If Shipper desires a specific
Transit Service he MUST specify Transit Service desired at the time
cargo is booked with the Carrier, either orally or in writing, unless
such instructions have been given previously. If no written
instructions are forwarded by the Shipper to the Carrier, Carrier's
booking records shall govern assignment of Transit Service level and
application of the rate.
b. Shipper's selection of a Transit Service level option
shall be considered paramount and Carrier will NOT alter
Shipper's instructions or the Transit Service/rate level
selected, EXCEPT in the following instances:
1. If Carrier forwards a shipment via a different Transit Service in
error, Shipper shall be assessed freight charges based on the
Transit Service level Shipper actually selected or the freight
charges applicable to the Transit Service actually provided,
whichever is lower. However, Carrier shall be free to provide a
higher Transit Service Level than the one Shipper requested for
Carrier's convenience; in such cases Shipper shall be assessed the
rate applicable for the Transit Service Level requested.
2. If due to an error or omission on Shipper's part,
cargo is held at Carrier's Terminal or Container Yard
and is not forwarded on the first available sailing
for the Transit Service selected, Carrier will give
the Shipper the option of waiting until the next
sailing for the Transit Service selected or of
changing the Transit Service status of the shipment.
If Shipper decides to change the Transit Service
selected, freight charges shall be assessed on the
basis of the Transit Service via which the shipment
actually moves. In either case all charges for
storage, container shifting or reloading or shipment
return, incurred as a result of Shipper's error or
ommission shall be for the account of the Shipper.
3. DEFINITION OF TRANSIT SERVICE LEVELS:
Except as otherwise provided in a Transit Service level specified
herein, when a shipment is assigned one of the Transit Services
named below under the terms and conditions of this Rule, Carrier
shall not be obligated to transport cargo in any particular
container or type of container or equipment (except as specified
in individual NSA, or in conformity with Rule 16), or via any
particular vessel, ocean, water, rail, motor or air carrier, or
in time for any particular market or otherwise than with
reasonable dispatch utilizing an underlying VOCCs' fixed sailing
schedule(s). When Carrier has been tendered two or more shipments
assigned to a different Transit Transit Service as named below,
that are to be loaded aboard the same vessel for off-loading at
the same POD, Carrier will tender such shipments to the underlying
VOCC for loading based on the priority level specified for each
Transit Service. For instance if two shipments are to loaded
aboard the same vessel at the POL and one is assigned a Transit
Service Level/Priority A/1 and another one is assigned a Transit
Service Level/Priority D/4, Carrier will insure that the shipment
assigned Priority Level A/1 is tendered to, and loaded aboard the
transporting vessel, before the shipment assigned Priority
Level D/4.
i. SERVICE TYPE A - EXPRESS TRANSIT SERVICE - PRIORITY LEVEL 1:
Carrier will utilize a regularly scheduled underlying VOCC having
a scheduled departure from POL within 4 days after receipt of
shipment by Carrier, without regard to scheduled transit time.
ii. SERVICE TYPE B - FAST TRANSIT SERVICE - PRIORITY LEVEL 2:
Carrier will utilize a regularly scheduled underlying VOCC with
a fixed day departure; having a scheduled transit time of less than
3 weeks; and will tender shipment to the VOCC for loading on the
earliest departure date available after receipt of the cargo
iii. SERVICE TYPE C - PRIORITY TRANSIT SERVICE - PRIORITY LEVEL 3:
Carrier will utilize a regularly scheduled underlying VOCC with
a fixed day departure without regard to scheduled transit time;
and without regard to scheduled departure date. When multiple
shiments assigned Priority and Standard Service are tendered to
Carrier, Carrier will tendered all shipments assigned Priority
Transit Service before any shipments assigned Standard Transit
Service.
iv. SERVICE TYPE D - REGULAR TRANSIT SERVICE - PRIORITY LEVEL 4:
Carrier will utilize a regularly scheduled underlying VOCC having
a regular scheduled departure every week from POL, without regard
to scheduled transit time.
v. SERVICE TYPE E - STANDARD TRANSIT SERVICE - PRIORITY LEVEL 5:
Carrier will utilize a regularly scheduled underlying VOCC with
a fixed day departure without regard to scheduled transit time;
and without regard to scheduled departure date. Multiple shiments
assigned Standard Transit Service will be tendered to underlying
VOCC based on "first in/first out" basis.
vi. SERVICE TYPE F - DIRECT TRANSIT SERVICE - PRIORITY LEVEL 6:
Carrier will utilize a regularly scheduled underlying VOCC with
a fixed day departure without regard to scheduled transit time;
and without regard to scheduled departure date. Shipments
assigned Direct Transit Service will be tendered to a underlying
VOCC providing a direct ocean through transportation service, in
which cargo/container is NOT off-loaded and transshipped from
one vessel to another between POL and POD.
vii. SERVICE TYPE G - INDIRECT TRANSIT SERVICE - PRIORITY LEVEL 7:
Carrier will utilize a regularly scheduled underlying VOCC with
a fixed day departure without regard to scheduled transit time;
and without regard to scheduled departure date. Shipments
assigned Direct Transit Service will be tendered to a underlying
VOCC providing an ocean through transportation service, in
which cargo/container is off-loaded and transshipped from
one vessel to another between POL and POD at least once during
through ocean service.
viii. SERVICE TYPE H - ECONOMY TRANSIT SERVICE/PRIORITY LEVEL 8:
Carrier will utilize a regularly scheduled underlying VOCC having
a regular scheduled departure every other week (bi-weekly) from
POL, without regard to scheduled transit time.
ix. SERVICE TYPE I - SLOW TRANSIT SERVICE - PRIORITY LEVEL 9:
Carrier may utilize an underlying VOCC with a Transit Time of more
than 4 weeks. No departure date will be guaranteed, and Carrier
will transport cargo SBJ to availability of space in Carrier's
Trailers/Containers. Cargo held at Terminal for Carrier's
convenience will NOT be SBJ to any applicable storage charges.
x. SERVICE TYPE J - DEFERRED TRANSIT SERVICE - PRIORITY LEVEL 10:
Carrier will utilize a regularly scheduled underlying VOCC with
a fixed day departure without regard to scheduled transit time;
and without regard to scheduled departure date. However, Carrier
will hold shipment after receipt of shipment and will not tender
shipment until specifically authorized by Shipper to commence
transportation. Cargo held at Terminal awaiting Shipper's
instructions convenience WILL be SBJ to any applicable storage
charges incurred.
