Control No. 13-12508 Once tendered to the Carrier, a shipment may be diverted or reconsigned while in the Carrier's possession prior to commencement of transportation, while in transit, or at billed destination, SBJ to the following provisions and charges. a. For definition of the terms "diversion" and "reconsignment" see Rule 28. All requests for diversion or reconsignment must be made, or confirmed, in writing, and all additional charges for requested diversion or reconsignment must be guaranteed by the party requesting the diversion or reconsignment service. Diversion or reconsignment orders must be made by or agreed to by the Shipper in the case of prepaid shipments and must be made by or agreed to by the Consignee in the case of collect shipments. b. The Carrier CANNOT obligate itself to divert or reconsign any shipment short of B/L destination once transportation service has commenced. However the Carrier will make every reasonable effort to effect requested diversion or reconsignment before the shipment reaches the original B/L destination. c. No additional charges will be assessed for diverting or reconsigning a shipment when the changes in instructions, shipping documents and/or B/L are made PRIOR to the commencement of transportation service, PROVIDED no charges for storage, drayage, detention, demurrage or similar charges are incurred. d. Except as otherwise provided in individual TLIs, all additional charges incurred by the Carrier when accomplishing a requested diversion or reconsignment service request is made AFTER the commencement of transportation shall be advanced by the Carrier for collection from the party requesting such service, which charges shall be in addition to the freight and charges for transportation service (see paragraph e.). e. Freight Charges on shipments diverted or reconsigned after transportation has commenced shall be calculated on the rate applicable from origin to original destination or diverted destination, whichever is higher. In cases where no rate has been published to apply to diverted destination, Carrier shall assess freight and charges applicable to original destination plus all additional charges incurred to deliver shipment to diverted destination.
