The application of Heavy Lift Cargo Charges will be governed by the
following provisions and conditions:
a. CARGO TENDERED TO OCEAN TRACK IN/ON OCEAN CONTAINER EQUIPMENT:
Cargo, subject to the rates, charges and provisions named in this
Tariff, when tendered to OCTK already loaded in/on ocean containers
or transporting equipment will NOT be subject to any Heavy Lift Charges.
However, OCTK reserves the right to refuse to accept any shipment
loaded in/on COL, SOL or underlying VOCC container equipment that is:
1) loaded beyond its marked weight capacity; or
2) when such container equipment is without manufacturers plate clearly
showing the specification of the container equipment, including its
maximum weight capacity; or
3) when Shipper fails to declare the gross weight of the loaded
container equipment.
Any fines or penalties imposed as a result of the misapplication or
misstatement of actual weight(s) on the B/L and/or other Shipping
Documents will be for the account of the cargo.
b. CARGO TENDERED TO CARRIER IN A BREAKBULK, LOOSE OR UNCONTAINERIZED FORM:
Except as otherwise provided in individual TLIs (Rate Items), Cargo,
subject to the rates, charges and provisions named in this Tariff, when
tendered to OCTK in a breakbulk, loose or uncontainerized form will
NOT be subject to any Heavy Lift Charges and will be accepted without
special arrangement PROVIDED the weight of each individual piece,
package or unit in the shipment does NOT exceed 1 W-ton. Shipments
containing individual pieces, packages or units weighing in excess of
1 W-ton will be accepted by OCTK for transportation ONLY after special
arrangement and prior booking, and will be SBJ to any applicable Heavy
Lift Charges as named below, or as specified in the TLI applying to
such shipment, which charge shall be in addition to all other applicable
charges. Shipper MUST provide a complete description, including gross
weight, of any article exceeding 1 W-ton at the time cargo is booked
with OCTK.

2. APPLICABLE ONLY WHEN SPECIFIC REFERENCE IS MADE HERETO (When Paragraph
c.2 applies, Paragraph c.1. above DOES NOT APPLY):
OCTK will assess the Heavy Weight/Density Surcharge which is named
in a specific note to a TLI (Rate Item) named in this Tariff when the
Density of the cargo being transported is less than a Density Factor
of 2.00 (see Example below). The Density Factor will be calculated as
follows:
When the total cubic measurement of the cargo is divided by the total
weight of the cargo and the result is less than 2, the Heavy
Weight/Density Surcharge named in the Rate TLI making reference hereto
will apply and be assessed, which charge shall be in addition to all
other charges.
EXAMPLE:
If Total cubic measurement of cargo is 3.2 CBM and total weight of
cargo is 1.5 Kilo tons (1500 Kilos); 3.2 divided by 1.5 equals a
Heavy Lift/Density Factor of 2.1, therefore, the Heavy Lift/Density
Surcharge named in the Rate TLI making reference hereto WILL NOT
apply. However if Total cubic measurement of cargo is 1.4 CBM and
total weight of cargo is 1.5 Kilo Tons (1500 Kilos); 1.4 divided by
1.5 equals a Heavy Lift/Density Factor of 0.9, therefore the Heavy
Lift/Density Factor Surcharge WILL APPLY.
