When an individual piece, package, pallet or other shipping unit is
tendered to Ocean Track (OCTK) for loading into an OCTK consolidated
Container ("S" Service - See Rule 2.1) for transportation and Shipper
prohibits, requests or advises OCTK NOT to stow any Cargo on top of, next
to and/or under their Cargo; OR when due to the nature of the Cargo
tendered, or its packaging, no Cargo can be stowed on top of, next to
and/or under such Cargo within an OCTK consolidated Container which results
in empty dead space remaining in the OCTK Container; OR when Shipper fails
to tender the full volume of Cargo booked with OCTK for loading within a
particular OCTk consolidated Container; OCTK will assess a NO-STACK CHARGE
(XDBL) provided in the Rate on the web rate page making reference hereto,
which charge shall be in addition to all other applicable charges.
  
a. When Shipper prohibits, requests or advises OCTK not to stow any Cargo
   on top of, next to and/or under their cargo which results in empty dead
   space remaining in the Container the XDBL will be as shown on the Web
   rate Page making reference hereto and will be based on the calculation
   shown below:
  
    The XDBL shall be calculated based on actual dimensions in cm minus 230
    cm, the inside container height of the OCTK consolidated container
    above which no other cargo can be loaded and the XDBL CHARGE WILL BE:
  
      XDBL charges will be either as calculated above times the total W/M
      rate for the volume of the empty unused space OR will be stated as a
      lumpsum charge on the Rate Page making reference hereto.
  
b. When due to the nature of the Cargo tendered, or its packaging, no Cargo
   can be stowed on top of, next to and/or under such Cargo within an OCTK
   consolidated Container which results in empty dead space remaining in
   the Container the XDBL CHARGE WILL BE:
  
      XDBL charges will be either as calculated above times the total W/M
      rate for the volume of the empty unused space OR will be stated as a
      lumpsum charge on the Rate Page making reference hereto.
  
c. When Shipper fails to tender the full volume of Cargo booked with OCTK
   by the Shipper for loading within a OCTK consolidated Container for a
   particular sailing date as specified as the OCTK CFS closing date for
   loading within that OCTK consolidated Container the XDBL CHARGE WILL BE:
  
      XDBL charges will be either as calculated above times the total W/M
      rate for the volume of the empty unused space OR will be stated as a
      lumpsum charge on the Rate Page making reference hereto.
