Each rate named in this Tariff applies via a specific
transportation/transit service which will be shown in connection with
such rate. A full description of each transportation/transit service
service offered is listed below:
I. ORIGIN/DESTINATION SERVICE DESCRIPTIONS (CODES):
a. "D" - DOOR SERVICE:
i. Door Service at origin INCLUDES either: DROP AND PICK (also known as
DROP AND PULL) service (i.e. Carrier's designated trucker will spot an
empty container at Shipper's premises so that Shipper can load
container without Carrier's designated trucker remaining at Shipper's
premises; Carrier's designated trucker returning later to pickup the
loaded container) and transportation service to destination; or LIVE
LOAD service (i.e. Carrier's designated trucker will spot an empty
container at Shipper's premises for loading while Carrier's designated
trucker remains with container until loading is completed by Shipper
and trucker is released to commence transportation service) and
transportation service to destination. Door Service at origin does
NOT include any stuffing, loading, blocking, bracing or staking of
cargo (including the count thereof) into/onto the container; NOR any
"relocating" or "shifting" of container while Container remains at
Shipper's premises; NOR does it include any applicable equipment
demurrage or motor vehicle detention charges incurred, even if the
Carrier is responsible for the collection thereof (Carrier will
forward such charges to Shipper for reimbursement at cost, EAN).
ii. Door Service at destination INCLUDES transportation to destination and
either: DROP AND PICK (also known as DROP AND PULL) service (i.e.
Carrier's designated trucker will deliver full container to
Consignee's premises for unloading by Consignee without Carrier's
designated trucker remaining at Consignee's premises; Carrier's
designated trucker returning later to pickup the unloaded, empty
container); or LIVE UNLOAD service (i.e. Carrier's designated trucker
will deliver loaded container to Consignee's premises for unloading by
Consignee while Carrier's designated trucker remains with container
until unloading is completed by Consignee and Carrier's trucker is
released). Except as otherwise provided, Door Service at destination
includes return of the empty container when unloading is completed.
Door Service at destination does NOT include the physical unloading of
cargo from container (including the count thereof), nor stripping, nor
cleaning of container; NOR does it include any "relocating" or
"shifting" of Container while Container remains at Consignee's
premises; NOR does it include any equipment demurrage or motor
vehicle detention charges incurred, even if the Carrier is responsible
for the collection thereof (Carrier will forward such charges to
Consignee for reimbursement at cost, EAN)
b. "K" - BREAKBULK (NON-CONTAINERIZED CARGO) SERVICE:
i. Breakbulk Service at Origin is defined as BBK ("K") Service applying
on Breakbulk, Non-Containerized or Non-Conterizable Cargo. BBK
Service at Origin will apply either SBJ to "Liner In" Terms or "Free
In" Terms as defined below. Where terms are NOT specified on an
individual Web Rate Page (TLI), Breakbulk Service Rates apply "Liner
In" at origin.
ii. Breakbulk Service at Destination is defined as BBK ("K") Service
applying on Breakbulk, Non-Containerized or Non-Containerizable Cargo.
BBK Service at Destination will apply either SBJ to "Liner Out" Terms
or "Free Out" Terms as defined below. Where terms are NOT specified
on an individual Web Rate Page (TLI), Breakbulk Service Rates apply
"Liner Out" at destination.
iii. "LINER IN" Terms ("L.I."): Liner In Terms at Origin means rate
INCLUDES receipt of cargo, free alongside, at point of rest, shipside;
loading cargo aboard vessel utilizing ship's or pier's equipment;
stowage of cargo on board vessel for safe transportation; and
transportation to destination. Liner In Terms, at Origin do NOT
include pickup or movement of the cargo prior to receipt at point of
rest, shipside; packaging, palletization or other preparation of cargo
for ocean transportation; storage, wharfage or warehouse charges at
port of origin; NOR any applicable terminal, wharfage or pier
receiving or service charges.
iv. LINER OUT" Terms ("L.O."): Liner Out Terms at Destination INCLUDES
transportation to destination; unloading cargo from vessel utilizing
ship's or pier's equipment; and delivery of cargo to Consignee at
point of rest, shipside. Liner Out Terms at Destination does NOT
include delivery or movement of cargo beyond point of rest; storage,
wharfage or warehouse charges at port of destination; NOR any
applicable terminal, wharfage or pier delivery or service charges.
v. "FREE IN" Terms ("F.I."): Free In Terms at Origin INCLUDES receipt of
cargo, free alongside, at point of rest, shipside; and transportation
to destination. Free In Terms at Origin does NOT include loading of
cargo aboard vessel; stowage of cargo on board vessel; pickup or
any movement of the cargo prior to receip of cargo at point of rest,
packaging, palletization or other preparation of cargo for ocean
transportation; storage, wharfage or warehouse charges at port of
origin; vessel loading; NOR any applicable Terminal, Wharfage or Pier
Receiving or Service Charges.
vi. FREE OUT" Terms ("F.O."): Free Out Terms at Destination INCLUDES
transportation to destination; and delivery of cargo to Consignee at
point of rest, shipside. Free Out Terms at Destination does NOT
include unloading cargo from vessel; delivery or movement of cargo
beyond point of rest, shipside; storage, wharfage or warehouse charges
at port of destination; vessel unloading charges; NOR any applicable
terminal, wharfage or pier delivery or service charges.
c. "O" - OCEAN PORT SERVICE:
i. Ocean Port Service at Origin is defined as either CFS ("S") Service
(see Paragraph f.) on LCL containerized cargo; OR as BBK ("K")
Service (see Paragraph b.) on Breakbulk, loose, non-containerized or
non-containerizable cargo; OR as Pier Roll-On ("Q") Service (see
Paragraph d.) when RO/RO Service is provided at origin; OR as CY ("Y")
Service (see Paragraph g.) on FCL Containerized cargo.
ii. Ocean Port Service at Destination is defined as either CFS ("S")
Service (see Paragraph f.) on LCL containerized cargo; OR as BBK ("K")
Service (see Paragraph b.) on Breakbulk, loose, non-containerized or
non-containerizable cargo; OR as Pier Roll-Off ("Q") Service (see
Paragraph d.) when RO/RO Service is provided at destination; OR as
CY ("Y") Service (see Paragraph g.) on FCL Containerized cargo.
d. "Q" - PIER ROLL-ON/ROLL-OFF (Ro/Ro) SERVICE:
i. Pier Ro/Ro Service at Origin INCLUDES loading of cargo aboard vessel
from end of Roll-On Ramp at shipside; stowage of cargo onboard vessel;
and transportation to destination. Pier RO/RO Service at origin does
NOT include pickup or prior movement of the cargo prior to receipt at
the end of Roll-On Ramp; packaging, palletization or other
preparataion of cargo for ocean transporatation; storage, wharfage,
handling or warehouse chares at origin; NOR does it include any
applicable Terminal or Pier Receiving or Service Charges.
ii. Pier Ro/Ro Service at Destination INCLUDES transportation from origin;
unloading of cargo from vessel and delivery to Consignee at end of
Roll-Off Ramp at shipside. Pier Service at Destination does NOT
include storage, wharfage, handling or warehouse charges at
destination; delivery or subsequent movement of cargo beyond end of
Roll-Off Ramp; NOR does it include any applicable Terminal, Pier or
Destination Delivery or Service Charges.
e. "R" - RAIL YARD (RAMP) SERVICE:
i. Rail Yard Service at Origin INCLUDES receipt by Rail Carrier of loaded
Container, which has been loaded off the premises of Rail Carrier;
placement of loaded Container aboard rail car equipment; and
transportation service to destination. Rail Yard Service at origin
does NOT include any stuffing, loading, blocking, bracing or staking
of cargo (including the count thereof) into/onto Container; delivery
of empty Container to Shipper's premises; transportation of loaded
Container from Shipper's premises to Rail Yard; NOR any equipment
demurrage or Rail Carrier yard/terminal storage charges incurred.
ii. Rail Yard Service at Destination INCLUDES transportation service to
destination Rail Yard/Ramp; removal of Container from rail car
equipment; and making loaded container available at Rail Yard for
Consignee to remove and unload Container off the premises of the Rail
Carrier yard or terminal. Rail Yard\Ramp Service at Destination does
NOT include delivery of loaded Container to Consignee's premises;
unloading of cargo and stripping or cleaning of Container; return of
empty Container to Rail or Container Yard; NOR any equipment demurrage
or Rail Carrier storage charges incurred.
f. "S" - CONTAINER FREIGHT STATION (CFS) SERVICE (See Rule 23 and Subrules
thereunder for and applicable Terminal Charges):
i. CFS Terminal Service at origin INCLUDES receipt of cargo at Carrier's
origin CFS Terminal; loading of cargo into/onto ocean Container(S)
(including furnishing and installing all blocking, bracing or staking
necessary to secure cargo in Container for safe transportation); and
transportation service to destination. CFS Service at origin does NOT
include pickup of cargo or other transportation services prior to
Carrier's receipt of cargo at CFS Terminal; unloading of cargo at
Carrier's CFS Terminal; CFS storage or warehouse charges incurred at
origin terminal; NOR any applicable terminal receiving, handling,
cross-dock or other terminal service charges, except as otherwise
noted in this Tariff.
ii. CFS Terminal Service at destination INCLUDES transportation service to
destination terminal; unloading of cargo and stripping of Container at
destination CFS Terminal; and making loose, uncontainerized cargo
available at CFS Terminal for Consignee pickup. CFS Terminal Service
at destination does NOT include delivery of loose, uncontainerized
cargo to Consignee's premises, NOR any other transportation service
subsequent to delivery at CFS Terminal; NOR loading of cargo into/onto
Consignee's equipment at CFS Terminal; NOR CFS storage or warehouse
charges incurred at destination terminal; NOR any applicable terminal
delivery, handling, cross-dock, destination delivery charges or other
terminal service charges, except as otherwise noted in this Tariff.
g. "Y" - CONTAINER YARD SERVICE (See Rule 23 and Subrules thereunder for
applicable Terminal Charges):
i. CY Terminal Service at origin INCLUDES making empty Container
available for Shipper to remove and load off the premises of the
Carrier; receipt of loaded Container at Carrier's nominated origin CY
Terminal; and transportation service to destination. CY Terminal
Service at origin does NOT include, except as noted in this Tariff,
delivery of empty Container to Shipper's premises NOR any other
transportation service prior to receipt of loaded Container at origin
CY Terminal; NOR any stuffing, loading, blocking, bracing or staking
of cargo (including the count thereof) into/onto Container; NOR
transportation of loaded Container from Shipper's premises to
Carrier's nominated CY Terminal; NOR any applicable equipment
demurrage charges or CY detention charges incurred, even if Carrier
is responsible for the collection thereof (Carrier will forward such
charges to Shipper for reimbursement at cost, EAN).
ii. CY Terminal Service at destination INCLUDES transportation service to
destination; and making loaded Container available for Consignee to
remove from CY to unload off the premises of the Carrier. CY Terminal
Service at destination does NOT include delivery of loaded Container
to Consignee's premises NOR any other transportation service
subsequent to delivery at CY destination Terminal; NOR unloading,
stripping and/or cleaning of Container; NOR return of empty Container
to Carrier's nominated CY Terminal; NOR any applicable equipment
demurrage charges or CY detention charges incurred, even if Carrier
is responsible for the collection thereof (Carrier will forward such
charges to Consignee for reimbursement at cost, EAN).
II. TRANSIT SERVICE DESCRIPTIONS:
Except as otherwise provided on individual Web Rate Pages (TLIs), all
shipments will be transported via Carrier's Regular Transit Service.
However, shipments moving on rates SBJ to one of the specific Transit
Services named below will apply ONLY when Shipper requests and/or agrees
to such Carrier provided service. Carrier offers the following Transit
Services.
a. When different rates applying on the same commodity, from the same
ports/points to the same ports/points are listed in this Tariff and the
application of the rates are based on different Transit Service levels,
selection of the Transit Service to be utilized, and hence the related
rate level to be assessed, will be strictly at the Shipper's option as
evidenced by Shipper's written standing instructions or written or oral
(except as noted below) confirmation provided at the time of booking.
Should Shipper book a shipment without providing written instructions as
to the Transit Service to be provided (other than otherwise provided
herein), Carrier's booking records shall govern the assignment of the
Transit Service level to be provided and rate to be assessed. If a
Shipper does NOT request or specify a specific Transit Service level,
Carrier will treat all cargo tendered for transportation as a Regular
Transit Service shipment and freight charges will be assessed
accordingly. If rate(s) on a specific web rate page is(are) indicated
as applying ONLY to specific transit service(s) other than Regular
Service (thus no rate is listed to apply when Regular Service is
provided), shipments of the commodity listed, from and to the
ports or points named therein, which move via Regular Service will be
assessed freight and charges based on the Service level with the lowest
published, effective rate.
b. Shipper's selection of a Transit Service level option shall be
considered paramount and Carrier may NOT and will NOT alter Shipper's
instructions or the Transit Service/rate level selected without a
change in instructions by Shipper. However, when due to an error or
other problem, a Transit Service specified or requested by Shipper is
not provided the following provisions will govern the assessement of
freight and other charges:
1. If Carrier forwards a shipment via a different Transit Service in
error, freight and charges shall be assessed based on the Transit
Service level selected by Shipper, or the freight and charges
applicable to the Transit Service actually provided, whichever is
lower. However, Carrier shall be free to provide a higher Transit
Service Level than the one Shipper requested for Carrier's
convenience; in such cases Shipper shall be assessed the rate
applicable for the Transit Service Level requested.
2. If, due to an error or omission on Shipper's part, cargo is held at
origin and is not forwarded to sail on the first available sailing for
the Transit Service selected, Carrier will give the Shipper the option
of waiting until the next sailing for the Transit Service selected or
of changing the Transit Service status of the shipment. If Shipper
decides to change the Transit Service selected, freight and charges
shall be assessed on the basis of the Transit Service via which the
shipment actually moves. In either case all charges for storage,
container shifting, reloading, or drayage, which are incurred as a
result of Shipper's error or ommission shall be for the account of
the cargo.
3. DEFINITION OF TRANSIT SERVICE LEVELS:
Except as otherwise provided in a Transit Service level specified
herein, when a shipment is assigned one of the Transit Services
named below under the terms and conditions of this Rule, Carrier
shall not be obligated to transport cargo in any particular
container or type of container or equipment (except as specified
on an individual Web Rate Page [TLI] or in conformity with Rule
16), or via any particular vessel, ocean, water, rail, motor or
air carrier, or in time for any particular market or otherwise
than with reasonable dispatch utilizing an underlying VOCCs'
fixed sailing schedule(s). When Carrier has been tendered two
or more shipments assigned to more than one Transit Services
named below, that are to be loaded aboard the same vessel for
off-loading at the same POD, Carrier will tender such shipments
to the underlying VOCC for loading based on the priority level
specified for each Transit Service. For instance if two
shipments are to loaded aboard the same vessel at the POL and
one is assigned a Transit Service Type "PRE" and another one is
assigned a Transit Service Type "ECO", Carrier will insure that the
shipment assigned Transit Service Type "PRE" is tendered to, and
loaded aboard the transporting vessel, before the shipment assigned
Transit Service Type "ECO."
i. SERVICE TYPE "PRE" - PREMIUM/GUARANTEED SAILING TRANSIT SERVICE:
Carrier will guarantee that Shipper's cargo will be loaded aboard
the vessel of an underlying VOCC (who maintains a regular sailing
schedule) on an agreed, specified sailing date. Any rate named in
this Tariff, for Regular or any otherwise specified transit service,
will be upgraded to Premium/Guaranteed Sailing Transit Service SBJ
to the following provisions:
1) Carrier must obtain prior written approval from the Shipper,
Consignee or freight charges payor, prior to upgrading Carrier's
service to Premium/Guaranteed Service;
2) All additional Charges assessed by the underlying VOCC for
guaranteed loading of cargo aboard it's vessel on a specified
date (guaranteed service) will be passed through at cost,
without markup or reduction, for collection with freight and
other applicable additional charges;
3) Carrier agrees that freight payor may request, and Carrier will
provide, copies of the underlying VOCC guaranteed service charge
invoice upon written request. In the case of LCL Cargo provided
Premium/Guaranteed Sailing Transit Service (when available),
additional charges assessed by the underlying VOCC will be
pro-rated using the method described in Rule 2.29 without markup
or reduction for collection with freight and other applicable
additional charges.
ii. SERVICE TYPE "EXP" - EXPRESS TRANSIT SERVICE: Carrier will
utilize a regularly scheduled underlying VOCC with a fixed day
departure and the fastest transit time or earliest departure date
after receipt of cargo. Carrier guarantees shipment will be loaded
aboard a VOCC vessel within at least 7 (seven) calendar days,
provided service is available. Unless Shipper specifies a specific
underlying VOCC be utilized, or, the rate Shipper selects is
assigned to a particular underlying VOCC in the rate section of this
Tariff, Carrier shall be free to select the underlying VOCC to be
used for the ocean transportation. Unless otherwise specified by
Shipper, Carrier shall be free to select the inland underlying
Carrier required at its discretion.
ii. SERVICE TYPE "FST" - FAST TRANSIT SERVICE:
Carrier will utilize a regularly scheduled underlying VOCC with
a fixed day departure; having a scheduled transit time of less than
3 weeks; and will tender shipment to the VOCC for loading on the
earliest departure date available after receipt of the cargo
iii. SERVICE TYPE "PRY"- PRIORITY TRANSIT SERVICE:
Carrier will utilize a regularly scheduled underlying VOCC with
a fixed day departure without regard to scheduled transit time;
and without regard to scheduled departure date. When multiple
shiments assigned Priority and Standard Service are tendered to
Carrier, Carrier will tendered all shipments assigned Priority
Transit Service before any shipments assigned Standard Transit
Service.
iv. SERVUCE TYPE "REG" - REGULAR TRANSIT SERVICE:
Carrier is NOT obligated to transport cargo: in any particular
container or type of container or equipment (except as specified on
individual Web Rate Pages (TLIs) or in conformity with Rule 16); OR
via any particular vessel, ocean, water, rail, motor or air carrier;
OR in time for any particular market or otherwise than with
reasonable dispatch utilizing an underlying VOCC's fixed sailing
schedule(s) or an NVOCC's advertised departure. Selection of
underlying VOCC, NVOCC or inland Carriers to be utilized for all or
any portion of the through transportation of cargo shall be at the
sole discretion of the Carrier.
v. SERVICE TYPE "STD" - STANDARD TRANSIT SERVICE:
Carrier is NOT obligated to transport cargo: in any particular
container or type of container or equipment (except as specified on
individual Web Rate Pages (TLIs) or in conformity with Rule 16); OR,
except as provided herein, via any particular vessel, ocean, water,
rail, motor or air carrier; OR in time for any particular market or
otherwise than with reasonable dispatch utilizing an underlying
VOCC's fixed sailing schedule(s) or an NVOCC's advertised departure.
However, Shipper will retain the right to specify that a particular
underlying Vessel, Ocean, NVOCC, Water, Motor or Rail Carrier be
utilized for all or any portion of a through transportation movement.
If Shipper fails to specify that a particular underlying VOCC, NVOCC
or inland Carrier be utilized for any portion of a through movement
and thus selection of the underlying Carrier to be utilized for that
portion of a through movement remains with the Carrier, Carrier shall
be free to select any underlying Carrier at its discretion.
vi. SERVICE TYPE "DIR" - DIRECT TRANSIT SERVICE:
Carrier will utilize a regularly scheduled underlying VOCC with
a fixed day departure without regard to scheduled transit time;
and without regard to scheduled departure date. Shipments
assigned Direct Transit Service will be tendered to a underlying
VOCC providing a direct ocean through transportation service, in
which cargo/container is NOT off-loaded and transshipped from
one vessel to another between POL and POD.
vii. SERVICE TYPE "IDR" - INDIRECT TRANSIT SERVICE:
Carrier will utilize a regularly scheduled underlying VOCC with
a fixed day departure without regard to scheduled transit time;
and without regard to scheduled departure date. Shipments
assigned InDirect Transit Service will be tendered to a underlying
VOCC providing an ocean through transportation service, in
which cargo/container is off-loaded and transshipped from
one vessel to another between POL and POD at least once during
through ocean service.
viii. SERVICE TYPE "DEF" - DEFERRED TRANSIT SERVICE:
Carrier may utilize an underlying VOCC or NVOCC with the longest
Transit Time between origin and destination. No departure date will
be guaranteed and Carrier will transport cargo SBJ to the
availability of space in Carrier's Trailers/Containers, and/or the
availablity of underlying Carrier(s). However, cargo will be loaded
aboard a transporting vessel within 2 (two) calendar weeks of cargo
receipt, provided service is available. Cargo held at a Terminal
for Carrier's convenience while awaiting loading into a Container or
movement to a Container Yard will NOT be SBJ to any applicable
storage charges. Carrier shall be free to select the underlying
VOCC or NVOCC to be used for the ocean transportation unless
selection is limited to the use of a specified VOCC or NVOCC on the
applicable Web Rate Page rate; and Carrier shall be free to select
the inland underlying Carrier at its discretion.
ix. SERVICE TYPE :SLO" - SLOW TRANSIT SERVICE:
Carrier may utilize an underlying VOCC with a Transit Time of more
than 4 weeks. No departure date will be guaranteed, and Carrier
will transport cargo SBJ to availability of space in Carrier's
Trailers/Containers. Cargo held at Terminal for Carrier's
convenience will NOT be SBJ to any applicable storage charges.
x. SERVICE TYPE "ECO" - ECONOMY TRANSIT SERVICE:
Carrier may utlize an underlying VOCC or NVOCC with the longest
Transit Time between origin and destination. No departure date will
be guaranteed, and Carrier will transport cargo SBJ to availability
of space in Carrier's Trailers/Containers, and/or availability of
underlying Carrier. However, cargo will be loaded aboard a
transporting vessel within 4 (four) calendar weeks of cargo receipt,
provided service is available. Cargo held at a Terminal for
Carrier's convenience while awaiting loading into a Container or
movement to a Container Yard will NOT be SBJ to any applicable
storage charges. Carrier shall be free to select the underlying VOCC
or NVOCC to be used for the ocean transportation unless selection is
limited to the use of a specified VOCC or NVOCC on the applicable Web
Rate Page rate; and Carrier shall be free to select the inland
underlying Carrier at its discretion.
xi. SERVICE TYPE "DLD" - DELAYED SERVICE:
Carrier will utilize a regularly scheduled underlying VOCC with
a fixed day departure without regard to scheduled transit time;
and without regard to scheduled departure date. However, Carrier
will hold shipment after receipt of shipment and will not tender
shipment until specifically authorized by Shipper to commence
transportation. Cargo held at Terminal awaiting Shipper's
instructions convenience WILL be SBJ to any applicable storage
charges incurred.
