RULE: 10.89 - LAX TRAFFIC MITIGATION FEE (PIERPASS) [TMF] Eff: 27MAR2006

a. Except as otherwise provided in individual TLIs, and
   EXCEPT when Beneficial Owner of the Cargo (BOC) makes
   independent arrangments to pay all TMF/PierPASS Charges
   on FCL shipments themselves, all shipments moving on
   the rates named in this Tariff, or in Tariffs subject to
   this Tariff, exiting the Marine Port Terminals of Los
   Angeles & Long Beach, CA via surface roads will be SBJ
   to the TRAFFIC MITIGATION FEE [TMF] (PierPass) named
   below, which charge shall be in addition to all other
   applicable charges.
   
   
  1. On LCL Shipments: Carrier will assess the charge listed
       below on all LCL Shipments moving in containers
       picked up from the Marine Ports Terminals named
       above:
    
{CE} EXPIRES with 23 April 2006    
         US$ 3.00 W/M, as freighted (SBJ to a Minimum
                         Charge of US$3.00 per B/L).
    
{CA} EFFECTIVE on 24 April 2006    
         US$ 4.00 W/M, as freighted (SBJ to a Minimum
                         Charge of US$4.00 per B/L).
    
       Exceptions:
          1.  Charge will NOT apply on Cargo moving in
                Containers entering or exiting the Marine
                Port Terminals via the Alameda Corridor
    
  2. On FCL Shipments: When upon the written request of
       Beneficial Owner of the Cargo, Carrier is required
       to pay Pier/PASS TRAFFIC MITIGATION FEE in order to
       pickup containers at the Marine Terminals named
       above, Carrier will assess a TMF as follows:
   
    I. FCL Shipments exiting the Port Terminals between
         the hours of 3:00AM thru 6:00PM, Monday through
         Friday will be assessed a TMF of:
    
{CE} EXPIRES with 23 April 2006    
           US$ 40.00 PC20X
           US$ 80.00 PC40X
           US$ 80.00 PC45X
    
{CA} EFFECTIVE on 24 April 2006    
           US$  50.00 PC20X
           US$ 100.00 PC40X
           US$ 100.00 PC45X
     
       Exceptions:
            1.  Charge will NOT apply on:
              A. Empty Containers
              B. Chassis without Containers
              C. Containers exiting the Port Terminals via
                  the Alameda Corridor
              D. Containers for which Beneficial Owner of
                  the Cargo has independently paid all
                  TMF/PierPASS Charges
    
   II. FCL Shipments exiting the Port Terminals between the
         hours of 6:01PM and 2:59AM, Monday through
         Thursday, or between the hours of 6:01PM Friday and
         2:59AM Monday:
    
           NO CHARGE SHALL BE ASSESSED
   
   
b. Carrier will assess the TMF HANDLING FEE named below on
   all FCL shipments, either when Carrier is responsible
   for both the payment of the TMF and the arrangement of
   the container release, or when Carrier only arranges
   container release on behalf of a BOC who independently
   pays the TMF.  This charge shall be in addition to and
   independent of any applicable TMF named above.
    
 EFFECTIVE 24 August 2005
       TMF Handling Fee:   US$ 20.00 PC
    
    
c. Before Carrier will handle any FCL Container exiting the
   Marine Port Terminals named above, every BOC MUST enter
   into a prior written agreement with Carrier specifying
   payment arrangements, peak or off-peak handling
   schedules and disposition of any resulting container
   demurrage charges.
