RULE: 2.6 - EQUIPMENT SUBSTITUTION Eff: 22Apr1996

Effective 22Apr1996
Filed 22Apr1996
Filing Codes C

Carrier is expressly authorized at its sole discretion for
any purpose whatsoever and without notice, to transfer the
goods from the container named in its bill of lading to
another or to others or temporarily to remove the container
from the container vessel, and any such transfer(s), move-
ment or substitution shall be deemed to be within the
contract voyage and not a deviation therefrom.
A. Dry for Dry Substitutions:
If the Carrier is unable to provide the container size
required by Shippers at time of booking due solely to lack
of available empty container or to other unavoidable
operational constraints, they have the option to substitute
other sizes of containers under the terms and conditions
outlined in the following paragraphs for per container
rated shipments only. A larger dry container may be sub-
stituted for the size of container required by the shipper.
When substitution is made, the ocean freight and charges
assessed shall be the same as what would have been furnished
provided that the cargo loaded in the larger container does
not exceed eighty-five (85%) of the total inside cubic
capacity (See paragraph C) of the smaller container in which
the shipment would have moved.
B. Reefer for Dry Substitutions:
At carrier's option, an equivalent size reefer container may
be substituted for a dry container. The base rate to apply
for such a substitution will be eighty-five percent (85%)
of the applicable base rate in effect for a dry container at
time of substitution and subject to all applicable charges
in effect for a dry container at time of substitution. The
provision is applicable only to per container rated
shipments.
C. For the purpose of this rule carrier's equipment speci-
fications will be as follows:
  For Dry Containers:
    PC20 - 33.41 CBM (1180 CFT)
    PC40 - 67.70 CBM (2391 CFT)
    PC40B - 76.42 CBM (2699 CFT)
D. The following clause must be put on all bills of lading
covering shipments freighted under this rule:
  "Equipment Substitution Performed"
Carriers indicate the size of equipment requested by Shipper
and the size of equipment provided by carrier under this
Rule 2.6.
E. Refer for Refer Substitutions:
If the Carrier is unable to provide the container size
required by shippers at time of booking due solely to lack
of available empty container or to other unavoidable
operational constraints, they have the option to substitute
other sizes of containers under the terms and conditions
outlined in the previous paragraphs for per container rated
shipments only. A larger refer container may be substituted
for the size of container required by the Shipper. When
substitution is made, the ocean freight and charges assessed
shall be the same as what would have been furnished provided
that the cargo loaded in the larger container does not
exceed eighty-five (85%) of the total inside cubic capacity
(See paragraph C) of the smaller container in which the
shipment would have moved.
