a. The rates and charges named in this Tariff are provided
to the Shipping Public in compliance with Section 8 of
the Shipping Act of 1984, as amended. Such Act requires
Ocean Common Carriers to establish and maintain, in an
FMC accepted electronic format, all rules and provisions
governing the transportation of cargo by the Carrier,
along with the exact rate and charges that will be
assessed by the Carrier for the transportation of such
cargo from origin, where cargo is tendered to carrier,
to destination, where cargo is delivered to Consignee.
b. Since the establishment and maintenance of a rate
tariff, such as this one is an on-going cost borne by
the Carrier, when specific is reference is made to this
Rule, Carrier will assess the "Tariff Filing Fee (TFF)"
named on the Web Rate Page making referernce hereto, each
and everytime such rate is established, extended or
amended in this Tariff to cover the transporation cargo
booked for shipment, which charge shall be in addition to
all other freight and additional charges named in this
Tariff. If cargo is transported SBJ to a rate already
established and currently in effect at the time cargo is
tendered to the Carrier for transportation, this
Surcharge shall be waived and not assessed. Additionally,
when cargo is transported on a minimum B/L charge, this
charge shall NOT be assessed.
c. The Tariff Filing Fee shall be invoiced to the party named
in the Carrier's B/L as responsible for the payment of
freight and charges, regardless of whether the cargo moves
prepaid or collect, and regardless of which party
originally books the cargo for transportation. When a
shipment, SBJ to a confirmed booking notice is canceled,
but a rate filing action has occured, Carrier will invoice
the party who booked the cargo for the rate filing.
