RULE: 2.52 - BULK CARGO LOADED IN INTERMODAL TANK CONTAINERS Eff: 08FEB2022

Shipments of Bulk Cargo (dry or liquid) loaded in intermodal tank
containers will be governed by the additional provisions and
conditions specified in this Rule. Such shipments of Bulk Cargo
will be assessed ONLY the rates named in this Tariff published to
apply on cargo "in bulk," "in tank containers," or applying "per
Tank Container" ("TC").
a. Carrier will provide bulk tank service ONLY when Carrier can
furnish tank equipment suitable for transporting the cargo being
tendered. Carrier will provide tank equipment that has been rough
cleaned (at no charge to the Shipper) prior to making it available
for Shipper use. "Rough Cleaned" means the tank container is
reasonably free from the remains of material foreign to the
commodity being tendered for transportation.
b. Except when providing Tank Containers in Dedicated Service to a
single Shipper, upon request of the Shipper, Carrier will, prior
to removal of tank container from Carrier's Terminal, advise
Shipper or his agent of the commodity last transported in the
tank equipment that is to be dispatched to Shipper for loading,
and shall on arrival of tank equipment at Shipper's premises,
permit inspection of the tank container by Shipper or his agent.
c. If the Shipper elects, at his own expense, to have the interior
of the tank container re-cleaned prior to loading, such action
shall relieve Carrier of any responsibility or liability for any
damage, contamination or loss of cargo resulting from the
condition of the interior of the tank container or residues found
therein.
d. The Shipper or his agent MUST load cargo into tank container at
his own risk and expense, affixing his seal to the tank container
cargo openings. Seals will NOT be broken until the cargo is
unloaded by the Consignee or his agent at destination, unless
Carrier exercises its option to inspect the cargo loaded in the
tank container. A notice of such inspection will be made on the
B/L and/or Shipping Documents. Bulk cargo shipments in intermodal
tank containers will be SBJ to the provisions of Rule 2.23
(Shipper's Load, Stow and Count). Shipper, Consignee and their
agents MUST either provide or compensate Carrier when it provides,
any compressors, pumps, hoses, fittings or other equipment
necessary to load cargo into tank container or to unload cargo
from tank container. Except as otherwise provided in an individual
NRA, or on a Web Rate Page in a Tariff governed by this Tariff, rates
do NOT include any charges for providing such equipment or services.
e. On shipments of cargo moving in tank containers, the Carrier's
liability will be limited to USD500.00 (See Carrier's B/L terms and
conditions) with respect to the entire contents of each container,
unless the Shipper declares a higher valuation on the shipment (SBJ
to all terms, conditions and charges named in Rule 12 of Tariff).
