A shipment moving on a rate named in a TLI making reference to this
Rule, may be stopped while in transit at the port/point specified in
the TLI making referece hereto for the purpose of partial loading,
completion of loading, or partial unloading SBJ to the following
provisions:
a. The entire combined shipment MUST move on a single B/L, from 1 (one)
Shipper, to 1 (one) Consignee.
b. The B/L and Shipping Orders MUST show the port(s) or point(s) at
which the shipment is to be stopped in transit for partial loading
or unloading, together with a complete description of the kind and
quantity of cargo to be loaded or unloaded at each port or point, as
well as the name and address of the party from whom each portion of
the shipment is to be picked up.
c. The substition of other property for that originally loaded or the
exchange of the contents of the load in any manner is strictly
prohibited.
d. All freight charges on shipments moving under the provisions of this
Rule, MUST be paid in full at one time by either the Shipper, the
Consignor or other party designated in the B/L.
e. On shipments stopped off in-transit for partial loading or unloading,
freight and charges calculated on other than a per container basis
shall be calculated on the basis of the actual weight or cube of the
entire combined shipment.
f. The Gross weight of any loaded container accorded Stopping-In-Transit
Service may NOT exceed highway weight limitations at any time during
over-the-road Service, unless Shipper, Consignee or their agent has
obtained specific authorization from relevant governmental
authorities and in NO event shall the gross weight of container and
contents exceed the maximum weight capacity of the container.
Further without regard to intent, negligence or any other factor,
Shipper, Consignee and their agents shall be and will remain jointly,
severally and absolutely liable for any fine, penalty or other
sanction imposed by any governmental authority on any container moving
under this Rule which exceeds lawful over-the-road or container
weight limitations.
