expressly set forth in the Rules of this tariff are declared "Open" and
are either:
    
  (a) published in the Members respective individual Tariffs listed
         below:

       Maersk Tariff FMC No. MAEU-519 (U.S. Outbound), OR FMC No.
         MAEU-640 (U.S. Inbound)
   
       Zim Tariff ISTR-024
   
  (b) OR have been expressly agreed to as part of an individual and
       confidential Service Contract between an ITC Member and the MOD.
