a. Hazardous or Dangerous Cargo (as described in 46 CFS
Parts 146-170) will NOT be accepted and handled at CFS
until and unless prior arrangements have been made with
and accepted by Arrowpac, all applicable Federal, State
or local authority permits have been obtained, and
unless all packaging, labeling, markings and
documentation of such hazardous cargo is in strict
compliance with all the rules, regulations and
provisions prescribed above as well as all applicable
Federal, State and Local statutes, ordinances and
regulations governing the handling and transportation of
such cargo.
b. When any cargo has been accepted into the CFS by
Arrowpac, and an error is found in the required
certification, packaging, labeling or any other lawful
requirements, all damages or penalties, actual and
consequential, shall be jointly and severally for the
account of the cargo, the party responsible for
complying with such requirements, and the party
tendering the cargo to Arrowpac.
