Shipments moving on the rates named in a NRA, NSA or a Rate Tariff TLI
governed by this Tariff, exiting the Port Terminals of Los Angeles &
Long Beach, CA via surface roads are SBJ to the TRAFFIC MITIGATION FEES
[TMF] (PierPass) named herein, which charge shall be in addition to all
other applicable charges.
    
a. ON FCL SHIPMENTS ONLY:
 1. Except as otherwise provided in an individual NRA, NSA or a Rate
    Tariff TLI governed hereby, and EXCEPT when Beneficial Owner of the
    Cargo (BOC) makes independent arrangements to directly pay all Pier
    Pass Fees applicable on FCL shipments, all shipments moving on a
    rate named in an NRA, NSA or Rate Tariff TLI governed hereby, which
    enters or exits the Marine Port Terminals of Los Angeles & Long
    Beach, CA via surface roads betwen the hours of 3:00 AM thru 6:00
    PM, Monday through Friday, will be SBJ to the PIER PASS FEE assessed
    by the Port Authorities.  Such charge will be advanced or forwarded
    by the Carrier for payment with all other freight and charges.
    
 2. Before Carrier will handle any FCL Container entering or exiting the
    Marine Port Terminals named above, every BOC needs to enter into a
    prior agreement with Carrier specifying payment arrangements and
    disposition of any container demurrage charges that result from
    Pier Pass requirements.
   
b. ON LCL SHIPMENTS ONLY:
   Carrier will assess the PIER PASS TRAFFIC MITIGATION FEE (TMF-LCL)
   listed below on all LCL shipments moving in containers picked up from
   or delivered to the Marine Port Terminals named in paragraph a.
