{C} Provisions of the Shipments Origin Non-EU POL Thru/FROB EU Ports
(ENS) named herein have been transferred from Tariff 060 to comply
with the FMC's Order in Docket No. 17-10 which amend the
Regulations governing NSAs (NVOCC Service Arrangements). This ENS
Rule shall apply to all UPS' NSAs, unless the original NSA
specifies it is not subject to an ENS or until an Amendment to a
governed NSA specifies it is not subject hereto.
Except as otherwise provided herein, all shipments moving on an
applicable rate named in a governed NSA that indicates the rates are
SBJ to the SHIPMENT ORIGIN NON-EU POL THRU/FROM EU PORTS (ENS) provided
below, will be SBJ to the BOL amount herein, which charge shall be in
addition to all other applicable charges:
Since any shipment moving on the Rates named in a governed NSA which
apply TO/THRU any POD in the United States Moving THRU or VIA any Port
in the European Union will be SBJ to the EU's IMPORT CONTROL SYSTEM
ENTRY SUMMARY DECLARTION, even if cargo remains on board a transporting
Vessel (FROB) which calls at any European Union Port before it is
discharged at POD, the provisions and charges of this Rule will apply
to such shipments as indicated by the listing of a European Union via
port on the web rate page in this Tariff rate section. The charge
named herein is being assessed to cover compliance with the European
Commission's Import Control System Regulations which require the
electronic filing of Entry Summary Declarations on all cargo moving
through, or remaining on board vessel at (FROB), any Port in the
European Union which must be electronically lodged through the European
Commission Import Control Systems' ENS at least 24 hours before the
commencement of loading at the United States POL.
a. On LCL shipments ORIGINATING AT A NON-EU PORT OF LOADING TO/THRU PODs
in the United States, Puerto Rico and the U.S. Virgin Islands
VIA/THRU/FROB at any European Union Port the applicable ENS will be
as follows:

If for any reason, other than Carrier's error or omission, any
correction and/or amendment is made to the data that was already
transmitted thru the European Commission's Entry Summary Declaration
System, Carrier will assess the END CORRECTION/AMENDMENT FEE named
below, which charge shall be in addition to all other applicable charges.
c. When a Correction/Amendment must be made to any ENS transmission
that has already occurred the applicable ENS CORRECTION/AMENDMENT
FEE will be as follows:
