RULE: 2.39 - SUBSTITUTION OF CONTAINERS/EQUIPMENT Eff: 31JAN2012

When Carrier publishes a rate in a Tariff Rate section
applying to a specific size container or piece of equipment
and/or when Shipper requests that a particular size
container or piece of equipment be made available for
transportation service, and due to operational exigencies
or unavailability of equipment, the Carrier is unable to
furnish the proper size container or piece of equipment,
Carrier may, at its option, transport cargo in, or furnish
Shipper with, a container or piece of equipment larger than
the size on which the rate is quoted and/or requested by
the Shipper, SBJ to the following conditions:
a. Freight charges will be calculated and assessed based on
the container or equipment size quoted and/or requested,
PROVIDED, the Shipper does NOT load more cargo into or
onto the container or equipment actually furnished than
an amount equal to 85% of the total inside capacity of
the smaller container quoted and/or requested. When
calculating the amount of cargo specified herein, the
total inside cubic capacity of each container size will
be:
20 ft. container, 8'6" high = 33.39 CBM
40 ft. container, 8'6" high = 67.75 CBM
40 ft. hi-cube container, 9'6" high = 76.40 CBM
45 ft. hi-cube container, 9'6" high = 86.37 CBM
If Shipper loads more into/on the container or equipment
than the amount of cargo specified above, freight
charges will be calculated and assessed based on the
container or equipment size provided.
b. When cargo is loaded into container or equipment by
Shipper or his agent, Shipper MUST furnish a complete
packing list and/or B/L showing actual weight and
measurement of cargo loaded into, or onto, container or
transporting equipment.
c. B/L is to be claused substantially as follows to insure
proper application of rate per this Rule:
"CARRIER SUBSTITUTED EQUIPMENT - _____ REQUESTED (HERE
SPECIFY TYPE AND SIZE EQUIPMENT ORIGINALLY REQUESTED)"
