Upon the written request of a Shipper, and when Carrier confirms terminal
space is available (at either a Carrier nominated or a Shipper nominated
terminal) Carrier will provide Seller's Consolidation Service by bringing
together and consolidating 2 (two) or more individual shipments of cargo
from a single Shipper for forwarding to 1 (one) or more Consignees, at
1 (one) time, in 1 (one) or more containers moving on a single B/L, to
1 (one) B/L destination, are SBJ to the following terms and conditions:
a. Carrier MUST receive a request (written or verbal) to perform "Seller's
Consolidation Service" prior to Carrier's receipt of any cargo for
which such service is to be performed.
b. Shipments or part shipment(s), lot(s) or unit(s) will NOT be accepted
at 1 (one) terminal for consolidation with cargo at another terminal.
However, upon request, Carrier will arrange for the transportation of
cargo from external points or terminals to the Consolidation Terminal
SBJ to the additional charges applicable for such movement (which
charge is outside the scope of the Carrier's House B/L).
c. When service is provided at Carrier's nominated Terminal:
1. Carrier does NOT hold itself out to load by specific commodity, mark,
or to perform any pre-sort or segregation of cargo prior to shipment.
Disposition of each shipment will be in strict accordance with the
instructions furnished by the party requesting the Seller's
Consolidation Service.
2. Carrier will load ONLY those shipments into a Seller's consolidated
container for which Carrier has received at consolidation origin
both the cargo and all requisite documentation, including mandated
government security and/or statistical information at least 72
hours prior to scheduled vessel departure on which the consolidated
container has been booked.
3. When any shipment, and/or its accompanying documentation and
mandated government information, that is identified for movement in
a Seller's consolidated container, is NOT received within the time
period specified in paragraph c.1. above, Carrier will hold such
shipment for inclusion in the next Seller's consolidated container
movement. If for any reason, such as incomplete documentation,
Shipper's instructions to hold, or for any other cause beyond the
control of the Carrier, a shipment cannot be forwarded in the next
scheduled Seller's consolidated container, all cargo so held at
terminal will be SBJ to all charges applicable for storage,
handling, and/or cargo shifting, which charge shall be in addition
to all other applicable charges.
d. When service is provided at Shipper's nominated Terminal:
1. When Carrier receives a consolidated container loaded at a Shipper
nominated terminal, Shipper MUST furnish a complete list of all
shipments included in the consolidated container along with all
requisite documentation, including mandated government security
and/or statistical information, at least 72 hours prior to
scheduled vessel departure on which the consolidated container has
been booked.
2. When any shipment, and/or its accompanying documentation and
mandated government information, that is identified for movement
within a Seller's consolidated container, that has been loaded at
a Shipper's nominated terminal, is NOT received within the time
period specified in paragraph d.1. above, Carrier will hold the
entire consolidated container until such documentation has been
received; OR, Carrier will give the Shipper the option of
collecting the consolidated container to remove the shipment(s) for
which documentation has not been provided from the consolidated
container. If for any reason, such as incomplete documentation,
Shipper's instructions to hold, or for any other cause beyond the
control of the Carrier, a consolidated container cannot be
forwarded to the underlyuing vessel operator with which the
shipment has been booked, such container will be held at the
receiving terminal and will be SBJ to all charges applicable for
storage, handling, and/or container shifting, which charge shall
be in addition to all other applicable charges.
e. Carrier will NOT provide Seller's Consolidation Service on any shipment
on which it has performed Buyer's Consolidation Service (see Rule
23.202).
f. Nothing in this Rule shall be constued as establishing joint thru
rates with any other Carrier or mode of transportation. When Carrier
is not provided with any specific instructions for on-carriage
transportation beyond the B/L Destination, Carrier will be free to
select any inland Carrier that will provide transportation to ultimate
destination.
g. GOVERNING PROVISIONS & CALCULATION OF FREIGHT CHARGES ON SELLER'S
CONSOLIDATED CONTAINERS:
Multiple shipments, moving on separate Carrier House B/Ls, destined to
multiple Consignees, which are transported in a single container SBJ
to the terms and conditions named in this Rule, will be assessed
freight and charges for each individual shipment in the consolidated
container based on a prorated portion of the applicable full
consolidated containerload rate and will be SBJ to the following
requirements and will be calculated as follows:
1. All shipments in the consolidated container must have the same
Shipper listed in each and every individual Carrier House B/L.
2. The applicable rate for each shipment in the consolidated container
will be calculated as specified below in paragraph 3. Alternatively,
if the freight and charges on ALL the shipments in a consolidated
container are to be paid by a single party, then upon request of the
single payer party, Carrier will assess all the applicable freight
and charges for the consolidated containerload on a single Carrier
House B/L covering one of the shipments in the consolidated container
while the remainder of the shipments in the consolidated container
will be rated at 0.00 (zero) with each zero rated House B/L
referencing the Carrier House B/L on which freight and charges have
been assessed.
3. Pro-Rated Freight and Charges for each individual shipment within a
consolidated container shall be calculated as follows:
A. Determine the total freight and charges (basic ocean or through
freight plus all applicable assessorial charges) applicable for the
FCL container movement.
B. Determine each shipment's payment status. If all the shipments in
the consolidated container are collect, the prorated freight and
charges shall be as determined in paragraph g.3.C., if some of the
shipments in the consolidated container are collect and some are
prepaid, the prorated freight and charges shall be as determined in
paragraph g.3.D.
C. If all shipments are collect or if all shipments are prepaid:
I. First determine each shipment's prorated cubic measurement portion
of the total measurement of the entire containerload volume (i.e.
if the total containerload volume is 25 cbm and one shipment is 5
cbm, that shipment's prorated portion is 20% [twenty percent] of
the shipment), rounded to the nearest tenth of a percent.
II. Second determine each shipment's prorated weight portion of the
total tare weight of the entire containerload (i.e. if total
containerload tare weight is 10,000 kilos and one shipment is
1,000 kilos, that shipment's prorated portion is 10% [ten percent]
of the shipment), rounded to the nearest tenth of a percent.
III. Multiply the applicable total freight and charges determined in
paragraph g.3.A. above by each shipment's prorated portion as
determined in paragraph g.3.C.I. above. Additionally, multiply
the applicable total freight and charges determined in paragraph
g.3.A. above by each shipment's prorated portion as determined in
paragraph g.3.C.II, above. Comparing the results of the two
calculations, the prorated freight and charges to be used for each
shipment in the consolidated container shall be whichever is most
advantageous to the largest number of shipments in the
consolidated container. Fractions of a cent will be disposed of
as follows: fractions of less than 1/2 cent will be dropped and
fractions of 1/2 cent or more will be increased to the next whole
cent.
D. If some shipments of collect and some are prepaid:
I. Determine each shipment's prorated cubic measurement portion of
the total measurement of the entire containerload volume (i.e. if
the total containerload volume is 25 cbm and one shipment is 5
cbm, that shipment's prorated portion is 20% [twenty percent] of
the shipment), rounded to the nearest tenth of a percent.
II. Multiply the applicable total freight charges determined in
paragraph g.3.A. above by each shipment's prorated portion as
determined in paragraph g.3.B. above. Fractions of a cent will be
disposed of as follows: fractions of less than 1/2 cent will be
dropped and fractions of 1/2 cent or more will be increased to the
next whole cent.
E. Add all the prorated portions as determined in paragraph g.3.C. or
g.3.D. together. If the total exceeds (because of rounding) the
total freight charges determined in paragraph g.3.A. above, subtract
the overage amount from the freight charges applicable to the
smallest shipment in the consolidated containerload. If the total
is less (because of rounding) than the total freight charges
determined in paragraph g.3.A. above, add the deficit amount to the
freight charges applicable to the largest shipment in the
consolidated containerload.
F. EXAMPLE:
Applicable FCL container Rate Is = $ 4000.00
