| Effective | 02JUN2011 |
|---|---|
| Filed | 02JUN2011 |
| Filing Codes | C |
Except as otherwise provided in individual Tariff Rules or TLIs, rates
and charges named in this Tariff, and in Tariff Rate Sections SBJ to
this Tariff, are stated in U.S. Currency and apply per weight unit, per
measurement unit, per container or lumpsum per shipment as specified.
Calculation of freight and additional charges will be based upon the
applicable rate, times the number of units tendered for transportation,
subject to the provisions named below.
a. "W" - Rates and/or additional charges stated on a weight
unit basis ("W" or "W-ton") apply per ton of 1000 kilos,
except as otherwise specifically indicated within a
Tariff Rate Item (See Codes listed under paragraph
a.iii). Where the rate basis unit is listed solely as
"W," freight charges shall be calculated without regard
to cubic measurement of cargo.
i. Freight and additional charges on shipments subject to
rates or charges stated on a weight unit basis will be
computed on the gross weight of the cargo including the
weight of all packing materials, pallets or shipping
containers (exclusive of the weight of the ocean
container) established at the time cargo is tendered
for transportation at origin.
ii. Carrier reserves the right to weigh or reweigh, on
certified scales, any cargo tendered for shipment. Any
weight so ascertained by the Carrier shall be deemed
paramount and shall be used to compute freight and
additional charges regardless of any other weight,
certified or otherwise, declared or provided by the
Shipper or his agent. Shipper may, however at his own
expense, seek independent certification of the
accuracy of any scales utilized by the Carrier.
iii. When the Rate Basis Code specified below are shown in
an individual Tariff Rate Items the weight basis shall
be:
100kg = 100 Kilos
100lb = 100 lbs.
250kg = 250 Kilos
300kg = 300 Kilos
333kg = 333 Kilos
363kg = 363 Kilos
500kg = 500 Kilos
800lb = 800 lbs.
CWT = 100 lbs.
KGS = 1 Kilogram
LBS = 1 pound
LT = 2240 lbs. (Long Ton)
ST = 2000 lbs. (Short Ton)
b. "M" - Rates and/or additional charges stated on a
measurement unit basis ("M" or "M-ton") apply per cubic
meter, except as otherwise specifically indicated within
a Tariff Rate Item (See Codes listed under paragraph
b.viii). Where the rate basis unit is listed solely as
"M," freight charges shall be calculated without regard
to weight of cargo, SBJ to the provisions of paragraph d.
i. Freight and additional charges on shipments subject to
rates or charges stated on a measurement unit basis
will be computed on the overall measurement of each
piece, package or unit in the shipment. The cubical
content of each piece, package or other unit shall be
the extreme dimensions of the length, width and height
of such piece, package or unit.
ii. Before any other calculations are made all fractional
centimeter or inch dimensions will be disposed of as
follows:
1. All fractions of less than one-half centimeter/inch
shall be dropped.
2. All fractions more one-half centimeter/inch shall be
rounded up to the next full centimeter/inch.
iii. When calculating the cube of all the pieces, packages
or units in a shipment, fractional cubic meters are to
be rounded off to the nearest 1/1000 (one
one-thousandth) cubic meter.
iv. When calculating freight and additional charges of an
irregular or unusually shaped piece, package or unit,
the 3 (three) greatest dimensions shall be used as the
rating measurements.
v. When calculating freight and additional charges of
Barrels, Casks, Kegs and Drums, or other
similar-shaped or irregular-shaped items, measurements
shall be taken on the square of the bilge.
vi. Whenever an individual piece, package or other shipping
unit is tendered for transportation and it is requested
by Shipper, or is necessary because of the nature of
the cargo or its packaging, that no cargo be stowed on
top of same, Carrier will use the maximum inside height
dimension of the transporting container as the height
of the cargo when calculating the freight or
assessorial charges.
vii. Where rates named in this Tariff are stated on a
weight basis and apply ONLY when the measurement of the
cargo is not to exceed a stated cubic measurement unit
per a stated weight unit, the total measurement of the
commodity, subject to such limitation, moving on a
single B/L will be the used to determine the applicable
rate when calculating freight charges instead of
utilizing the measurement/weight ratio of each
individual piece, package or unit in the shipment.
viii. When the Rate Basis Code specified below are shown in
an individual Tariff Rate Items the measurement basis
shall be:
CBM = cubic meter
CFT = cubic foot
4cbm = 4 cubic meters
{C}
ix. Carrier reserves the right to measure or re-measure, using a
professional surveyor, any cargo tendered for shipment. Any
measurement so ascertained by the Carrier shall be deemed
paramount and shall be used to compute freight and additional
charges regardless of any other measurement, certified or
otherwise, declared or provided by the Shipper or his agent.
Shipper may, however at his own expense, seek independent
certification of the accuracy of any surveyor utilized by the
Carrier, or the accuracy of any measurement provided by such
surveyor.
c. "WM" - Rates and/or additional charges stated on an
alternating weight unit or measurement unit apply per the
weight or measurement unit, as defined in paragraphs a.
or b. above (see Codes listed below), whichever produces
the greatest revenue to the Carrier, SBJ to the
provisions of paragraph d.
250kg/M = 250 Kilos / 1 cbm
300kg/M = 300 Kilos / 1 cbm
333kg/M = 333 Kilos / 1 cbm
363kg/M = 363 Kilos / 1 cbm
450kg/M = 400 Kilos / 1 cbm
500kg/M = 500 Kilos / 1 cbm
800lb/M = 800 lbs. / 1 cbm
CWT/CFT = 100 lbs. / 1 cubic foot
W/2 = 1000 kilos / 2cbm
W/3 = 1000 kilos / 3cbm
{CR}
d. DENSITY EXCEPTION (Applicable ONLY on shipments moving on a rate named
in a Tariff rate section specifying a Rate Basis of 363kgs or 800lbs
per cbm):
Except as otherwise provided in Notes 1 & 2, CFS cargo moving to
United States inland points on a rate specifying a Rate Basis of 363kgs
or 800lbs per cbm will be SBJ to a maximum density of 363kgs or 800lbs
per cubic meter. If the cargo's density exceeds 363kgs or 800lbs per
cubic meter, freight charges shall be calculated as follows: divide
363kgs or 800lbs into the total weight and then multiply the result by
the cubic meter rate. (Example: Freight Charges on a shipment from
Hong Kong to Atlanta measuring 3 cubic meters and weighing 3000 kgs
which moves on a Rate of US$109 per 363kgs or 1 cbm will be calculated
by dividing the 3000 kgs by 363kgs equaling a factor of approximately
8.2644; this factor is then to be multiplied by the per cbm rate of
US$109 for a total freight charge of US$900.83). This Density
Exception is NOT applicable when the shipment is moving on a weight
only rate.
NOTE 1: The Density Exception named in paragraph d. above does NOT
apply on shipments from Ports and Points in Europe and the C.I.S.,
named in Rules 1.3C and 1.4C in Tariff Section 020, or subsequent
reissues, (Trade Lane "C") to inland points in the United States.
NOTE 2: The Density Exception named in paragraph d. above does NOT
apply on shipments from Ports and Points in India named in Rules 1.3A
and 1.4A in Tariff Section 058, or subsequent reissues, (Trade Lane
"A") to inland points in the United States.
e. "LFT" - Rates and/or additional charges stated on a per
LFT basis will apply per Linear Foot Length.

and assessorial charges billed on the basis of weight
and/or measurement are in all cases SBJ to revision and
correction if the weights and/or measurements are found
to be incorrectly stated or declared regardless of the
party responsible for the original error.
