It is recognized that a strike, lockout, work stoppage, work slowdown
or other labor-related disruption to operations at any U.S./Canada
Port (collectively, labor unrest) will cause congestion at other
U.S./Canada Ports.
Accordingly, notwithstanding any other provision in this Tariff Rate
Section, in the event of labor unrest, cargo received by the Carrier or
its Agent after the effective date of the charge named in this Rule
scheduled to arrive at any U.S./Canada (West Coast, East Coast or Gulf
Coast) Port on or after 1 July 2014 shall be subject to the congestion
charge named herein. However, regardless of any indication on a
web rate page, the General Port Congestion Surcharge named herein will
apply when, and only when, labor unrest occurs, or the threat of such
labor unrest causes, and results in, congestion at such affected Port or
any other U.S. Port. If there is no labor unrest at any U.S. Port and/or
Port Congestion does not occur at any other U.S. Port, the Surcharge
named herein will NOT be assessed.
