Freight charges, assessorial charges, surcharges or other
charges named in this Tariff including advanced charges
MUST be prepaid (unless prior arrangements to accept
collect payment have been concluded SBJ to the provisions
of paragraph d. - see NOTE 1) at origin or destination, SBJ
to the provisions named herein. However, regardless of
whether B/L payment status is prepaid or collect, the
Shipper, his duly authorized Freight Forwarder, the
Consignee and the Beneficial Cargo Owner shall be, and will
remain, jointly and severally liable for all unpaid charges
and freight, including but not limited to, any sums
advanced or disbursed by the Carrier for the account of the
cargo.
NOTE 1: Shipments of the following commodities MUST always
be PREPAID in all instances: Household Goods; Personal
Effects; Privately Owned Automobiles; Refused/Returned
Shipments
a. All freight and additional charges named in this Tariff,
are due and considered earned upon receipt of the cargo
by the originating Carrier, or his agent, and shall be
paid to the Carrier without discount or deduction,
whether the ship and/or cargo is lost or not lost,
transportation is interrupted or abandoned, whether the
cargo is damaged or ruined, or whether packages or
containers are delivered empty or partly empty at
destination.
b. PREPAID FREIGHT And PREPAYMENT OF FREIGHT -
When freight or other charges are prepaid, B/L must not
be issued except upon actual payment of such freight or
charges in U.S. Dollars or in foreign currency (SBj to
paragraph e. below). Prepayment of freight or charges
at destination MUST be made in full for the complete
original B/L quantity prior to the release of any
original ocean B/L by the Carrier to the Shipper or his
duly authorized licensed Freight Forwarder or his agent.
c. COLLECT FREIGHT -
When freight or other charges are collect, all collect
freight and charges MUST be paid prior to the ocean
Carrier prior to release or delivery of cargo at
terminal ports of discharge or destination.
d. In the event Consignee or his agent refuses to pay
freight and other charges, and merchandise remains
undeliverable thereby, Shipper guarantees and remains
liable for full payment of freight and other charges,
together with any expense incurred while Carrier awaits
instructions for the disposition of cargo.
e. Rates and charges named in this Tariff, are quoted in
U.S. Currency and have been determined with due
consideration to the relationship of U.S Currency to the
other currencies involved, In the event of any material
deterioration in the exchange value of U.S. Currency,
Carrier reserves the right, upon lawful publication, to
adjust the rates and charges named in this Tariff to
remove any adverse effect in conformity with the U.S.
Shipping Act of 1984, as amended, and the regulations of
the Federal Maritime Commission issued pursuant thereto.
f. When freight and other charges named in this Tariff are
collected in foreign countries, Carrier will accept
payment in a foreign currency provided it is freely
convertible. When payment is effected in other than
U.S. Currency, currency conversion shall be calculated
on the basis of the highest (numerical) Telegraphic
Transfer Selling Rate of Exchange (TTS) in effect on the
day the shipment is tendered to originating Carrier.
g. The payment status of a B/L may NOT be changed once
transportation service of cargo has commenced (i.e.
"prepaid" shipments cannot be changed to "collect"
shipments and likewise "collect" shipments cannot be
changed to "prepaid" shipments) without the express
approval of the Carrier.
h. All Freight charges MUST be paid to the Carrier before
release of the cargo, unless prior arrangements to the
contrary have been made with the Carrier.
